The news broke on Tuesday that on May 28, Dolphins Hall of Fame quarterback Dan Marino, along with 14 other retired NFL players, filed a class action concussion lawsuit against the NFL. I wrote about it here for TSN. The news also broke on Tuesday that Dolphins Hall of Fame quarterback Dan Marino was withdrawing from his concussion lawsuit against the NFL. So why the change of heart? Probably a couple of reasons. First, Marino has reportedly been speaking with the CEO and President of the Dolphins Tom Garfinkel about joining the teams front office. Clearly, filing a lawsuit against the NFL would jeopardize his chances gaining employment with the Dolphins. The Dolphins, along with the rest of the NFL teams, will ultimately be responsible for paying out whatever money is owed to the players as a result of the concussion lawsuits. Having a plaintiff as an employee in that circumstance would be a bit awkward. So given Marinos ambitions to join the Dolphins in an executive position, the timing of the lawsuit was unusual. Before suing someone, the potential personal and professional impact of that lawsuit on the client is assessed and discussed in great depth. In this case, the potential fallout was inescapable. The timing of the lawsuit was a surprise for another reason. In August 2013, the NFL announced that it had settled the over 220 concussion lawsuits involving nearly 5,000 former NFL players and their families. The league agreed to pay the players nearly a billion dollars in exchange for the players dropping their lawsuits. Before a settlement is finalized, however, the Court has to approve it. To date, it has rejected the settlement twice. Once approved, though, the settlement would bind every single retired NFL player as of the Court approval date. Since Marino retired on March 13, 2000, that would include him. So at this time, there was not a pressing need for Marino to sue the NFL. He was already covered by the potential NFL settlement. If for some reason he ends up being unhappy with the Court approved settlement (if and when that day comes), he could simply opt out of the settlement and file his own lawsuit. Every player will have that right to walk away from the Court approved settlement and file their own lawsuit. Orioles Jerseys 2019 . A quick first step to get to the hoop for a layup. The team said Wednesday night that an X-ray revealed the injury. Warriors coach Mark Jackson and Bogut both said hes out indefinitely and gave no timetable for his return. Speaking in a sombre tone in his corner of the locker room, though, Bogut said he has done enough research and spoken to enough doctors that he will not come back until the rib heals. "Ive got to be careful, because if it cracks Im looking at a punctured lung. Youll see me in the hospital with a tube coming out of me," Bogut said. "Its one of those things people have played through, but this is too close to comfort for me." Bogut said he first felt the injury when Denvers Kenneth Faried elbowed him in a loss to the Nuggets last Thursday. The symptoms continued against the Los Angeles Lakers on Friday, he said, and he took a pain-killing injection before playing at Portland on Sunday night. Bogut left the overtime loss to the Trail Blazers in the fourth quarter after getting sandwiched by two players. He said he cant take deep breaths and is pain anytime he coughs or sneezes — let alone tries to run. "It definitely wasnt as bad until I fully ccracked it," Bogut said.dddddddddddd "I thought I was winded for a second, but it wasnt going away. I ended up going back in the game for the last possession (of regulation). I dont know how." Backup centre Jermaine ONeal was starting in Boguts place Monday night against Minnesota. Jackson also said he also could slide power forward David Lee to centre if needed depending on the matchup in the playoffs. Last years backup centre, Festus Ezeli, has been out all season recovering from right knee surgery and remains day to day. Jackson also indicated that reserve centres Hilton Armstrong and Ognjez Kuzmic are likely not options. "It certainly does not make us a better basketball team," Jackson said of Boguts absence. Golden States centre is hardly the only one ailing at the worst time of the season. Starting small forward Andre Iguodala sat out Monday night with right knee tendinitis that he has said is something he will have to deal with for the rest of the season. Lee is playing with a nerve injury in his right hamstring/back right and ONeal has been coping with pain in his wrist and knees. Harrison Barnes started for Iguodala against the Timberwolves. The Warriors visit Denver in their regular-season finale Wednesday night before the playoffs begin Saturday or Sunday. ' ' '
