ALLENTOWN, Pa. -- An eastern Pennsylvania judge says she wont dismiss the homicide charges against former pro wrestling star Jimmy Superfly Snuka in the death of his girlfriend more than three decades ago but may consider doing so later.The Lehigh County judge in June ruled the 73-year-old defendant mentally incompetent to stand trial in his girlfriends 1983 death. She declined prosecutors request to have him involuntarily committed to a mental hospital.Prosecutors then asked the judge to either require Snuka to participate in outpatient treatment to determine whether he can become mentally competent or dismiss the charges.If you believe that hes not going to become competent, then whats the point? Chief Deputy District Attorney Charles Gallagher III asked Judge Kelly Banach in court on Tuesday. We ask you to dismiss the charges.Banach said she wasnt comfortable with dismissing the charges at this point but wanted to revisit the case at Snukas next evaluation hearing in December. She said she was open to reconsidering her decision if new evidence to drop the charges was presented.The defense has argued that Snuka suffers from dementia, partly due to the head trauma he suffered over a long career in the ring. A prosecution expert said Snukas brain shows normal signs of aging and suggested that he might be feigning symptoms. Gallagher repeated that contention Tuesday, saying the defendant has been an actor his whole life.Banach, who questioned Snuka herself earlier, said in June that she found the wrestler vacant and unable to assist in his defense. I dont believe hes faking it. I dont think hes smart enough to fake it, Banach said in June.If Banach grants the prosecutions motion to require outpatient treatment, its unclear where Snuka would receive it. Defense attorney Robert Kirwan said his client plans to move to Florida to live with his son.Snuka, a native of Fiji who lives in New Jersey, was charged last year with third-degree murder and involuntary manslaughter in the death of 23-year-old Nancy Argentino, whose body was found in their Whitehall Township hotel room. Joey Logano, his Team Penske teammate, and at least one driver from Joe Gibbs Racing.Its hardly the scenario Keselowski predicted a week ago when he sat in the middle of the Chase standings with five drivers clumped together facing elimination. By his estimation, the four drivers knocked from the Chase field would come from that group. He figured the fifth would win a race to advance into the round of eight.Keselowski got that part correct: Kevin Harvicks win on Sunday took him from last in the Chase standings into the third round. What he didnt predict: Contact that led to a 38th-place finish at Kansas.Now Keselowski is 11th in the standings headed to Talladega Superspeedway, where the field will be cut from 12 to eight. Although hes suddenly in very dangerous territory, he didnt seem overly worried and doesnt consider this weeks race a must win.Keselowski is a four-time winner at Talladega, including a 2014 must-win victory that pushed him from the brink of elimination into the third round. Its just, this is a team sport, and youve got to have every facet of the car and the team all put together and weve just got to execute.Hamlin of all drivers understands the complexity of Sundays race at Talladega. Only Jimmie Johnson and Harvick, winners of the first two races in the second round, are safe and breathing easy.Even though the standings show only seven points separate Logano and Autin Dillon, tied for eighth, from Keselowski in 11th, anyone in the field can be kicked out after Talladega. Hamlin was second in the standings at Talladega last year, but finished 37th and was eliminated.That means none of the Gibbs drivers are guaranteed anything, and odds are at least one of them will be knocked out on Sunday. Same goes for the two Penske drivers. Considering where they are in the standings, it will be difficult for both Keselowski and Logano to advance out of Talladega.So the stage is set for a walk-off home run that could save the season for the winner at Talladega.Among those who will be swinging the fences is Chase Elliott, the rookie who has found himself in the second round of the Chase but last in the standings. Elliott is 25 points behind the cutoff, and almost certainly must win at Talladega to remain in the playoff field.Should he pull it off, it would be the first Sprint Cup win of his career. He won the pole at Talladega earlier this year and finished fifth, so anything is possible.I will go there and race our hearts out and try to win, I guess, Elliott said. Thats about all we can do.
